Welcome to the EsperCare - an EsperGroup Company.At EsperCare, we offer services and content through our applications. We provide services to you subject to the following notices, terms, and conditions (the “Terms”).Please read these terms carefully.
These terms, as modified or amended from time to time, form a binding contract between EsperCare (“we” and/or “us,” etc.) and you ("you”).You may only use the EsperCare Apps operated by EsperCare if you accept these terms.In addition, when you use any current or future EsperCare service, visit, or purchase from any business affiliated with EsperCare, you will be subject to the guidelines and conditions applicable to such service or business. If these terms are inconsistent with EsperCare’s terms, those terms will prevail.
If you create an account on the App, you are responsible for maintaining the security of your account and data, and you are fully responsible for all activities that occur under the account. You must immediately notify EsperCare of any unauthorized uses of your data, your account, or any other breaches of security.
You may not use the account, username, or password of another user at any time or disclose your password to any third party or permit any third party to access your account.

EsperCare values your privacy and adheres to its Privacy Policy to ensure a pleasant experience. Please read our Privacy Policy, incorporated herein, as part of these Terms. We reserve the right to contact you regarding compliance or the performance of these Terms or any content or activities relating to the App. You acknowledge that EsperCare may preserve content and may also disclose content if required to do so by law or in good faith, believing that such preservation or disclosure is reasonably necessary to: (a) comply with legal processes; (b) enforce these Terms; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property, or personal safety of EsperCare, App users, and the public.
What This Privacy Policy Covers
This policy covers how EsperCare treats personal information collected or received through the EsperCare services we provide. Personal information is data about you that is personally identifiable, such as your name, email address, or phone number, and any information that is not otherwise publicly available. This policy does not apply to practices of companies we do not own or control or to people we do not employ or manage. Third-party companies, such as our Internet access, website, and email hosting providers, have their own privacy statements.
Information Collection and Use
EsperCare collects personal information when you use our services. When contracting with us, we will ask for your name, email address, and phone number. The EsperCare App may occasionally collect usage information, including session numbers, responses, and session duration, to enhance your experience. This data is stored on our server logs and used anonymously, with no personal identifiers accessible to us, the developer. EsperCare uses collected information to provide updates, fulfill requests, improve services, contact you, conduct research, and optimize the App.
Ownership of Content
You acknowledge that: (i) EsperCare owns all rights, title, and interest in all content posted, generated, or contributed (“the Content”) to the App by you or other users; and (ii) nothing in this Agreement grants you any ownership of the content or any license other than rights expressly provided in this Agreement.
Emails
We may occasionally send you emails regarding your account activity, purchases, and updates about our products and promotional offers. You may opt out of receiving promotional emails at any time.
Information Sharing and Disclosure
EsperCare does not rent, sell, or share personal information with other people or companies except in the following circumstances:We provide shipping information to shippers for product delivery.We respond to subpoenas, court orders, or legal processes to establish or exercise legal rights or defend against claims.We share information with law enforcement to investigate or prevent illegal activities, suspected fraud, or situations involving potential physical harm, as required by law.
Confidentiality and Security
We limit access to personal information to those we believe reasonably need it to provide our services. We have physical, electronic, and procedural safeguards to protect personal information.
Changes to This Privacy Policy
This policy may be updated to adapt to changing needs of society and law. Significant changes to our treatment of personal information will be communicated via an amended Privacy Policy linked on the App.
Ordering of Services; Conduct of Services
If you choose to order a product or service through the App, we strive to provide it to the best of our ability. However, we make no warranties regarding satisfaction. Access to content created by others can be revoked at our discretion. Prices for services, where applicable, will be listed on the App and may change from time to time.
Customer Support
You may contact EsperCare Customer Services via the provided contact in the app store. The provision of customer support is at EsperCare’s sole discretion, and we have no obligation to provide support of any kind.
Intellectual Property Notices
You may not use the name “EsperCare” or any trademarks listed on the App or in any App content without permission. All rights are reserved.
Minimum Age Requirement
The App is intended for users at least 18 years old or the legal age required to form a binding contract in your jurisdiction. By using the App, you represent that you are at least 18 years old.
Dealings with Merchants; Links
The App may contain advertisements, offers, or links to other sites and resources controlled by third parties. You acknowledge and agree that EsperCare is not responsible for the availability, accuracy, or content of such sites or resources. Use of these links is at your own risk.
Electronic Communications
You agree to electronic communication for all transactions and communications with EsperCare and the App, including notices, disclosures, and other communications that satisfy any legal requirement for written communication.
Modifications to Terms and Privacy Policy
EsperCare reserves the right to modify, add, or remove parts of these Terms and the Privacy Policy at our sole discretion. Changes will take effect immediately upon posting. Continued use of the App following any changes constitutes acceptance.
Prohibited Conduct
You agree not to engage in prohibited activities, including but not limited to tampering with information, using automated means to access the App, impersonating others, or posting offensive content. Violations will be subject to legal and corrective actions.
Protection of App Content
The App is protected by intellectual property laws, and you agree to respect these laws. All content, including text, logos, images, and software, is the exclusive property of EsperCare or its content suppliers.
Termination or Cancellation
EsperCare reserves the right to terminate your access to the App at our sole discretion. If you use the App after termination, such use constitutes your agreement to the Terms then posted on the App.
Indemnification
You agree to hold EsperCare and its affiliates harmless and indemnify them from any claims arising from your use of the App, your violation of these Terms, or any unauthorized disclosures.
Limitation of Liability
EsperCare and its affiliates will not be liable to you for any damages or losses arising from your use of the App, including direct, indirect, incidental, punitive, or consequential damages.
Additional Terms
- Severance: If any part of the Terms is found invalid or unenforceable, the remaining provisions remain in effect.
- No Assignment: These Terms are personal to you and may not be assigned or transferred without express written permission from EsperCare.
- Disputes; Choice of Law: By using the App, you agree to resolve any disputes through arbitration rather than in court.
- Limitations on Actions: Actions concerning disputes related to the App must commence within one year of the cause.
Entire Agreement: These Terms constitute the complete agreement between you and EsperCare regarding the use of the App.
No Waiver: EsperCare's failure to act with respect to a breach does not constitute a waiver of rights.
